Construction

Our attorneys are well versed in construction law, representing parties on some of the largest projects in Michigan. Our clients include municipalities, governmental authorities, developers, contractors, utilities, and insurers.

These projects often entail highly technical requirements pertaining to design and engineering specifications, building methods, compliance, timing and quality of work, site conditions, and costs. We provide counsel at all stages of the construction process, from negotiating and drafting contracts, to appearing on behalf of clients in any necessary regulatory proceedings, to pursuing rights and relief in court, arbitration, and other forums when disputes arise.

On any given day, you will find us hard at work on matters involving:

  • Construction defects
  • Contract changes and termination
  • Financing and workouts
  • Architectural and engineering disputes
  • Regulatory compliance
  • Environmental issues
  • Michigan Builders Trust Fund and lien disputes
  • Delay or acceleration claims
  • Warranty disputes
  • Public and private ventures
  • Toxic tort and mold suits

Our clients depend on us to move mountains, and we consistently rise to the challenge.

The successes we have achieved in the boardroom and the courtroom have paved the way for a number of important projects and initiatives in the region, such as:

Detroit Metropolitan Midfield Terminal

Retained by Northwest Airlines to act as lead litigation counsel in the three-phase, $1.6 billion Edward H. McNamara Terminal project – the largest such project in Southeast Michigan in decades. Northwest was responsible for managing all design and construction pursuant to a project development agreement with Wayne County, and our representation spanned a 12-year period and included over 50 separate matters.

City of Dearborn – Combined Sewer Overflow Project (CSO)

Retained by the City to prosecute and defend claims against contractors, architects and engineers, insurers, sureties, and subcontractors on the $300 million CSO project.
